These Terms and Conditions apply when you use the Sydney Cabs Online website, submit a booking request, communicate with us about transportation services or use transportation that is booked or arranged through Sydney Cabs Online.

By submitting a booking request or otherwise using our services, you agree to these Terms and Conditions together with any fare information, booking confirmation, Cancellation & Refund Policy and Privacy Policy that applies to your booking.

If you make a booking for another passenger, you confirm that you have authority to make the booking and provide the information required for that passenger's journey.

Business Details

About Sydney Cabs Online

Sydney Cabs Online is the customer-facing brand used by the business operating under the registered business name SYD Cabs Online, ABN 56 039 059 513.

The website sydneycabsonline.com.au is used to provide information about transportation services and to receive booking enquiries and booking requests for journeys in Sydney and surrounding areas.

Sydney Cabs Online is independently operated and is not affiliated with, authorised by, endorsed by or officially connected with any other taxi or transportation brand unless expressly stated. Third-party trademarks and brand names remain the property of their respective owners.

Booking Requests and Confirmation

Information submitted through our website is used to request transportation. You must provide accurate and sufficiently complete information, including your name, contact details, pickup location, destination, travel date and time, passenger requirements and any relevant flight information.

Unless we expressly confirm otherwise, submitting an online form does not by itself guarantee that a vehicle or driver has been allocated.

A booking should be treated as confirmed when you receive confirmation from Sydney Cabs Online or from the transport provider handling the booking.

You should review the details of your confirmation and promptly tell us if any information is incorrect. Changes requested after confirmation may affect availability or the applicable fare.

NSW Requirements

NSW Point to Point Transport Requirements

Transportation booked or arranged through Sydney Cabs Online is subject to applicable New South Wales laws and regulations, including requirements that apply to point to point passenger transport and booking services.

Depending on the type of journey and vehicle, relevant requirements may arise under the Point to Point Transport (Taxis and Hire Vehicles) Act 2016 (NSW) and the Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017 (NSW) , as amended from time to time.

Nothing in these Terms is intended to override a requirement imposed by applicable transport, consumer, road safety or other Australian law.

Important Fare Information

Fare Estimates and Acceptance

For a booked passenger service, a fare estimate will be provided before the journey begins as required by applicable NSW point to point transport law.

The fare estimate may be expressed as a set amount, a rate based on distance, a rate based on time, or a combination of permitted pricing methods.

Where the fare may vary, the fare information will identify the circumstances in which it may vary and explain the amount of the variation or how that variation is calculated.

Applicable additional fees or charges associated with the booking or passenger service will be identified as required before the journey.

A booked journey will not commence until the applicable fare estimate has been accepted by or on behalf of the passenger.

Where a fixed fare is expressly agreed before the journey, the fare charged will be handled in accordance with applicable NSW fare requirements.

Fares, Fees and Payments

All prices and fare estimates are expressed in Australian dollars unless otherwise stated.

Depending on the booking, the fare information may account for matters such as the journey distance, expected travel time, pickup arrangements, vehicle requirements and other charges applicable to the requested passenger service.

Tolls, airport-related charges, waiting charges, booking charges, payment-related charges or other amounts will only apply where applicable and will be disclosed or dealt with in accordance with applicable law and the fare information provided for the booking.

Available payment methods may include card, Cabcharge, cash or another method confirmed for the particular booking.

You are responsible for paying lawful amounts properly due for a service that has been provided. Nothing in these Terms requires you to pay an amount that cannot lawfully be charged.

Pickup and Drop-Off Information

You are responsible for providing an accurate pickup location, destination and contact number.

You should be available at the nominated pickup location at the agreed or confirmed pickup time and remain reasonably contactable using the telephone number supplied with the booking.

Where access to a pickup or drop-off location is restricted, including private premises, secure buildings, event areas or restricted road locations, you should provide any relevant instructions in advance.

A driver may need to use a nearby safe and lawful pickup or drop-off location if stopping at the exact requested location is unsafe, unlawful or impracticable.

Sydney Airport Bookings

For airport pickups, you should provide the correct terminal, flight number, expected arrival date and any other information reasonably required to arrange the pickup.

If flight information is provided, it may be used to assist with coordinating the requested pickup. However, airline schedule changes, airport restrictions, baggage delays, immigration delays, road conditions and other circumstances can affect the actual pickup time.

Airport pickup points may be subject to airport rules, designated pickup zones, traffic arrangements and access requirements that apply at the time of travel.

Passenger Responsibilities

Passengers must comply with applicable laws, reasonable safety directions and lawful instructions given by the driver.

Passengers must not intentionally damage or excessively soil a vehicle, interfere with the safe operation of the vehicle, threaten or abuse a driver or another passenger, or engage in unlawful conduct.

The number of passengers and the amount of luggage must be suitable for the vehicle that has been requested or allocated.

You should tell us before confirmation if you will be travelling with unusually large luggage, mobility equipment, sporting equipment, multiple large bags or another item that may require a different vehicle.

Children, Accessibility and Special Requirements

If a passenger requires a particular accessibility arrangement, child restraint, wheelchair-accessible vehicle or another special requirement, you should inform us when making the booking request.

A request for specialised equipment or a particular vehicle type is subject to confirmation and availability.

Applicable NSW road safety, passenger transport and accessibility requirements will continue to apply regardless of these Terms.

Vehicles and Drivers

A vehicle shown on the website may represent a vehicle category rather than the exact vehicle that will perform your journey.

Unless an exact make or model is specifically confirmed as part of your booking, a reasonably appropriate vehicle may be allocated based on availability and the requirements supplied with your booking.

Where required under applicable NSW booking service rules, information sufficient to allow the passenger to identify the booked vehicle and driver will be made available.

Traffic, Delays and Journey Times

Pickup times, arrival times and journey durations may be affected by circumstances such as traffic, accidents, roadworks, weather, airport congestion, major events, road closures and other conditions.

Unless a particular time has expressly been guaranteed in writing, quoted journey times and estimated arrival times should be treated as estimates rather than absolute guarantees.

We will not use this section to exclude any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Booking Changes, Cancellations and Refunds

If you need to change or cancel a booking, please contact Sydney Cabs Online as soon as reasonably possible.

Any cancellation fee, no-show fee, waiting charge or other cancellation-related condition will only apply where it has been properly disclosed as part of the applicable booking terms or fare information and is permitted by law.

Our separate Cancellation & Refund Policy forms part of these Terms where applicable.

Nothing in our Cancellation & Refund Policy or these Terms excludes any refund, cancellation, compensation or other remedy that you are legally entitled to under the Australian Consumer Law.

Drivers and Third-Party Transport Providers

Depending on the booking arrangements, a journey may be provided or fulfilled by a driver or transport provider involved in servicing the booking.

Relevant booking information may be communicated to that driver or provider so the journey can be arranged and performed.

Any driver or transport provider involved in a journey remains subject to applicable legal, regulatory and safety requirements.

The involvement of another service provider does not remove any rights you may have under applicable consumer law.

Safety and Refusal or Termination of Service

Subject to applicable law, a journey may be refused, interrupted or terminated where reasonably necessary to protect the safety of the driver, passenger, vehicle or public.

This may include circumstances involving threatening or violent behaviour, unlawful conduct, serious interference with the driver, unsafe passenger or luggage arrangements, or another genuine safety concern.

Any payment, cancellation or refund consequences arising from such circumstances will remain subject to applicable law and the terms properly disclosed for the booking.

Lost Property

Passengers are responsible for checking that they have collected their belongings when leaving the vehicle.

If you believe that an item has been left in a vehicle, contact us as soon as possible with your booking details and a description of the item.

We may assist with contacting the relevant driver or transport provider, but recovery of an item cannot be guaranteed.

Nothing in this section excludes responsibility for loss or damage where liability cannot lawfully be excluded.

Your Legal Rights

Australian Consumer Law

Our services come with consumer rights and guarantees that may apply under the Australian Consumer Law.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Where the Australian Consumer Law applies, services must meet the applicable consumer guarantees, including requirements relating to due care and skill, fitness for an agreed purpose and supply within a reasonable time where no time has been fixed.

Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

To the extent permitted by law, Sydney Cabs Online is not responsible for loss caused solely by events outside its reasonable control where the loss was not caused or contributed to by a failure to comply with an applicable legal obligation.

You should allow reasonable additional travel time where arrival by a particular time is important, including for flights, appointments, events and onward transport connections.

Website Use

You must not misuse this website, attempt to gain unauthorised access to systems, submit fraudulent bookings, interfere with website functionality or use the website for an unlawful purpose.

Website availability may occasionally be affected by maintenance, technical faults, hosting issues or circumstances outside our reasonable control.

Content on this website may not be copied, republished or commercially exploited without permission except where permitted by law.

Privacy and Personal Information

Personal information provided in connection with a booking or enquiry will be handled in accordance with our Privacy Policy and applicable privacy requirements.

By providing another person's personal information, you confirm that you are authorised to provide that information for the purpose of arranging the requested journey.

Complaints and Disputes

If you have a concern about a fare, booking, driver, journey or other aspect of our service, please contact Sydney Cabs Online and provide sufficient booking information for us to review the matter.

We will aim to review complaints reasonably and may request additional information where required.

Nothing in these Terms prevents you from exercising rights available through NSW Fair Trading, the relevant transport regulator, a court, tribunal or another authority where applicable.

Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our services, commercial arrangements or applicable legal requirements.

Updated Terms will be published on this website with an updated effective date.

Changes will not be used to retrospectively impose a materially different charge or condition on a confirmed booking where doing so would be unlawful or inconsistent with the terms agreed for that booking.

Governing Law

These Terms and Conditions are governed by the laws applicable in New South Wales, Australia.

Any dispute relating to these Terms will be subject to the jurisdiction of the courts and tribunals competent to determine the matter, subject to any rights you have under applicable consumer or other law.
